1. Introduction & Agreement Overview

Welcome to reMovalist Near mE ("we," "our," or "us"). These Terms and Conditions ("Terms") outline the rules and responsibilities for using our online removalist quote platform (the "Platform"). By accessing or using our services, you agree to comply with these Terms and with all applicable Australian laws, including the Australian Consumer Law (ACL) under Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Our Platform connects individuals or businesses seeking moving or removalist services ("Customers") with independent service providers ("Removalists") who submit quotes for consideration. We act only as an intermediary and do not directly provide removalist services.

Please read these Terms carefully. By using the Platform, you confirm that:

You are at least 18 years of age.

You have read, understood, and agreed to these Terms.

You consent to our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. Platform Services & Role

Our Platform provides a digital marketplace where Customers can submit requests for moving services, and Removalists can provide quotes. We do not own, operate, or employ any Removalists listed on the Platform. Instead, we act as an intermediary to facilitate communication and transactions between Customers and independent service providers.

While we make efforts to ensure accurate listings and reliable information, we do not guarantee the quality, safety, or legality of any services offered by Removalists. It is the sole responsibility of Customers to assess Removalists, including checking insurance, licences, experience, and reputation before engaging them.

Similarly, Removalists are responsible for ensuring their quotes are accurate, fair, and reflective of the service to be provided. They must also comply with applicable Australian laws, including consumer guarantees under the Australian Consumer Law (ACL).

We may verify certain information about Removalists but are under no legal obligation to do so. Users acknowledge that any contractual relationship for removalist services is directly between the Customer and the Removalist.

3. User Eligibility

To use the Platform, you must:

Be at least 18 years old;

Have the legal capacity to enter into a binding contract;

Provide accurate, up-to-date information when registering an account or requesting a quote; and

Comply with these Terms and all applicable laws in Australia.

We reserve the right to suspend or terminate access to the Platform if we suspect fraudulent activity, misuse, or violation of these Terms.

4. Account Registration & Security

Some features of the Platform may require account registration. When creating an account, you agree to:

Provide true, current, and complete information;

Maintain the confidentiality of your login details;

Notify us immediately of any unauthorised access or security breach.

You are responsible for all activities conducted under your account. We are not liable for any loss or damage resulting from your failure to maintain the security of your login credentials.

5. Quote Request & Acceptance

Customers may submit a service request through the Platform by providing details such as:

Type of move (home, office, etc.);

Location and destination;

Preferred date and time;

Special requirements (e.g., packing, fragile items, storage).

Removalists may respond with quotes, including service details and pricing. Customers are free to compare and choose the most suitable quote.

Once a Customer accepts a quote, a direct agreement is formed between the Customer and the Removalist. We are not a party to this contract and are not liable for any disputes, cancellations, or service outcomes.

6. Fees & Payments

Use of the Platform may be free for Customers but may include listing or commission fees for Removalists. Any fees applicable will be clearly displayed before confirmation.

All payments for services are made directly between Customers and Removalists unless otherwise specified. We do not hold, transfer, or manage Customer funds unless expressly agreed in writing.

Removalists are solely responsible for providing tax invoices and complying with Australian taxation laws, including Goods and Services Tax (GST) obligations where applicable.

7. Cancellation & Refund Policy

Cancellations and refunds are subject to the terms agreed between the Customer and the Removalist.

If a Customer cancels a confirmed booking, any refund will be determined by the Removalist's cancellation policy.

If a Removalist cancels, they are responsible for notifying the Customer promptly and arranging a resolution.

We are not responsible for issuing refunds unless a separate written agreement with us states otherwise.

8. Responsibilities of Customers

Customers agree to:

Provide accurate and complete details when requesting quotes;

Ensure safe access for Removalists to complete their work;

Review and verify Removalists' qualifications, insurance, and service terms before accepting a quote;

Comply with all laws and regulations applicable to their move.

9. Responsibilities of Removalists

Removalists agree to:

Provide accurate quotes that reflect actual service costs;

Maintain valid insurance, licences, and permits required under Australian law;

Perform services with reasonable care and skill as required under the Australian Consumer Law;

Respond promptly to Customer inquiries and maintain professionalism throughout the service.

10. Prohibited Activities

You agree not to:

Use the Platform for unlawful, fraudulent, or misleading purposes;

Post false or misleading information;

Circumvent our Platform by engaging directly with users to avoid fees;

Upload or transmit harmful code or attempt to disrupt the Platform's functionality.

11. Limitation of Liability

To the maximum extent permitted by Australian law, we are not liable for:

Any loss, damage, or injury resulting from services provided by Removalists;

Disputes between Customers and Removalists;

Errors, delays, or interruptions in the Platform's operation.

Nothing in these Terms limits your rights under the Australian Consumer Law, including guarantees that cannot be excluded.

12. Dispute Resolution

In case of disputes between Customers and Removalists, parties should first attempt to resolve the issue directly. If unresolved, parties may pursue:

Mediation or alternative dispute resolution methods; or

Legal action in the appropriate jurisdiction within Australia.

We may, at our discretion, assist in dispute resolution but are under no obligation to do so.

13. Privacy & Data Protection

We handle personal information in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Information collected may include names, contact details, service requirements, and payment information (if applicable). This data is used solely for providing and improving the Platform and will not be shared with third parties except as required by law or with your consent.

By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
